House rejects Net neutrality rules

The U.S. House of Representatives definitively rejected the concept of Net neutrality on Thursday, dealing a bitter blow to Internet companies like Amazon.com, eBay and Google that had engaged in a last-minute lobbying campaign to support it.

By a 269-152 vote that fell largely along party lines, the House Republican leadership mustered enough votes to reject a Democrat-backed amendment that would have enshrined stiff Net neutrality regulations into federal law and prevented broadband providers from treating some Internet sites differently from others.

Of the 421 House members who participated in the vote that took place around 6:30 p.m. PT, the vast majority of Net neutrality supporters were Democrats. Republicans represented most of the opposition.

The vote on the amendment (click for PDF) came after nearly a full day of debate on the topic, which prominent Democrats predicted would come to represent a turning point in the history of the Internet.

“The future Sergey Brins, the future Marc Andreessens, of Netscape and Google…are going to have to pay taxes” to broadband providers, said Rep. Ed Markey, the Massachusetts Democrat behind the Net neutrality amendment. This vote will change “the Internet for the rest of eternity,” he warned.

A Note to Google Users on Net Neutrality:

. . . In the next few days, the House of Representatives is going to vote on a bill that would fundamentally alter the Internet. That bill, and one that may come up for a key vote in the Senate in the next few weeks, would give the big phone and cable companies the power to pick and choose what you will be able to see and do on the Internet.

Today the Internet is an information highway where anybody – no matter how large or small, how traditional or unconventional – has equal access. But the phone and cable monopolies, who control almost all Internet access, want the power to choose who gets access to high-speed lanes and whose content gets seen first and fastest. They want to build a two-tiered system and block the on-ramps for those who can’t pay.

Creativity, innovation and a free and open marketplace are all at stake in this fight. Please call your representative (202-224-3121) and let your voice be heard. . . .

Without net neutrality, the Internet would start to look like cable TV. A handful of massive companies would control access and distribution of content, deciding what you get to see and how much it costs. Major industries such as health care, finance, retailing and gambling would face huge tariffs for fast, secure Internet use — all subject to discriminatory and exclusive dealmaking with telephone and cable giants.

We would lose the opportunity to vastly expand access and distribution of independent news and community information through broadband television. More than 60 percent of Web content is created by regular people, not corporations. How will this innovation and production thrive if creators must seek permission from a cartel of network owners?

The smell of windfall profits is in the air in Washington. The phone companies are pulling out all the stops to legislate themselves monopoly power. They’re spending tens of millions of dollars on inside-the-Beltway print, radio and TV ads; high-priced lobbyists; coin-operated think tanks; and sham “Astroturf” groups — fake grass-roots operations with such Orwellian names as Hands Off the Internet and NetCompetition.org.

They’re opposed by a real grass-roots coalition of more than 700 groups, 5,000 bloggers and 750,000 individual Americans who have rallied in support of net neutrality at http://www.savetheinternet.com/ .

We follow the story of Blip.tv, an ambitious video-streaming startup. They’re fighting for a corner of the Internet marketplace in the midst of a battle over so-called ‘net neutrality’ — the idea that all Internet content and websites are given the same access to audiences and customers.

If telecommunication giants have their way, companies like Blip.tv might be forced to compete in a marketplace wherein firms with large coffers can buy access to greater bandwidth and faster Internet speeds, leaving sites who can’t afford to pay in the slow lane.

Craig Aaron of Free Press, a media watchdog group, says big telecom companies have declared open season on ‘Net neutrality.’ He’s afraid these companies will dictate how we use the Internet.

“I think one of the beauties of the Internet is that it’s been open to views across the political spectrum. And if you hand the control of the information so that some can be preferred over others, you’re going to be handing that control to the big media companies that already control our television, airwaves, radio, you name it,” Aaron says.

For their part, telecom companies argue that a fast lane on the Internet for those willing to pay will allow them to make a return on their multibillion-dollar investment in broadband infrastructure. At present, companies such as Verizon and AT&T only charge for access to the Internet, but make virtually no money from content.

Net Neutrality Is More Than Meets The Eye

What’s bewildering in the net neutrality debate is that both sides say they have the same goals – they want the Internet to maintain its usefulness, to keep maturing, and to continue to get better. At first glance, it would be easy to think that one side wants that done via government regulation and the other through the free market. But that’s really not the case. Network neutrality is a much more complex issue than “Big Business vs. Consumer Rights” or “Big Government vs. Free-market Competition”.

Realist View on Net Neutrality: Only the Lawyers Win

Ray Gifford offers a realist’s prognostication on the likely effects of network neutrality: only the lawyers win.

Not the end of the world if network neutrality laws pass, not the end of the world if they fail to pass. Only, if network neutrality becomes law, low latency high-speed service will be routed through “private networks” while ordinary traffic travels via the “public network” internet. The distinctions between the two will be somewhat arbitrary, but important to the law, and that is why lawyers win. Overall, a sensible if not too hopeful view.

Compare the calm Gifford tone to the more alarmist sounds of eBay CEO Meg Whitman (that’s her smiling face in the picture) in an email sent to members of the “eBay community”: . . .

Now it seems that while they didn’t quite get the substantive message, consumeraffairs.com has picked up some of the terminology. In a story posted yesterday, it lauded Rep. James Sensenbrenner for introducing a net regulation bill, saying “when it comes to the issue of net neutrality, Sensenbrenner is on the side of the underdog.�

At the risk of becoming repetitive, the underdog in this particular catfight includes the following companies (along with their rank on the Fortune 500 list):

Net neutrality field in Congress gets crowded

“Legislation that prohibits us from providing network management services for the benefit of consumers is a solution in search of a problem,” said Bill McCloskey, a spokesman for BellSouth, which opposes the bill and other regulatory versions like it.

The new bill, like most of its similar counterparts, does outline carve-outs from the rules for network management activities related to security and other consumer protection services.

Also buried in the proposal is a requirement that providers offer their customers the option of standalone, or “naked” broadband services without an obligation to subscribe to cable television, telephone or Internet phone.

Vested interest? Whatever do you mean?

“It is premature to attempt to enact some sort of network neutrality principles into law now,” says the letter, which was signed by 34 companies and sent to House Majority Leader Dennis Hastert and Minority Leader Nancy Pelosi. “Legislating in the absence of real understanding of the issue risks both solving the wrong problem and hobbling the rapidly developing new technologies and business models of the Internet with rigid, potentially stultifying rules.”

Oh yes, let’s all come to a real understanding of the issues, shall we? I know I for one would love to hear an explanation for what happened to the $200 billion in tax cuts and other incentives the telecoms were given to roll out fiber to the home by 2006 (see “We thought you said spend the $200 billion on ‘dark fiber’ “)?
